Purchase Policy

1. Acceptance of Terms

By accessing Le Birdie’s facilities, booking a session, or using its equipment, you acknowledge that you have read, understood, and agreed to these General Conditions.
If you do not agree with any of these terms, please do not use our services or access our facilities.

2. Safe Use of Facilities

Users are fully responsible for their own safety and the safety of others while using the facilities.

Children under 16 must be accompanied by an adult at all times.

Improper, unsafe, or non-compliant use of simulators, clubs, or equipment is strictly prohibited.

Clients must follow all posted safety instructions, any guidance provided by Le Birdie, and must use equipment only for its intended purpose.

Le Birdie reserves the right to refuse access or expel any user who does not comply with these rules, without refund.

3. Damage to Equipment and Facilities

Users are responsible for any damage, breakage, or deterioration caused to Le Birdie’s equipment, facilities, or accessories resulting from negligence, misuse, or inappropriate behavior.

Le Birdie reserves the right to charge repair, replacement, or cleaning fees as it deems necessary.

In the case of major damage, the client may be required to reimburse the full replacement value of the damaged equipment.

4. Responsibility of the Booking Holder

The person who made the reservation is responsible for all members of their group during the booking period.

They are legally responsible for any damage, incident, inappropriate behavior, or rule violations committed by their guests.

By making a reservation, this person agrees to indemnify Le Birdie for any loss, claim, or expense resulting from the actions of their group.

5. Door Security and Access

Clients must ensure that doors close and lock properly after entering or exiting the premises.

The booking holder is responsible for any damage, theft, or incident resulting from unauthorized access caused by a door left open or improperly secured.

Access is strictly limited to the people listed on the reservation. Any unauthorized entry constitutes a violation of these terms and may result in sanctions.

6. Prohibition of Drugs, Alcohol, and Illegal Activities

The consumption of drugs, illicit substances, or alcoholic beverages is strictly prohibited.

Any illegal or inappropriate activity will result in immediate expulsion without refund and may be reported to the appropriate authorities.

Le Birdie reserves the right to refuse future access to any offending individual.

7. Limitation of Liability

Clients use the facilities at their own risk.

Le Birdie cannot be held liable for injuries, losses, or material or bodily damage sustained on its premises, except in cases of proven gross negligence or intentional misconduct on its part.

Le Birdie assumes no responsibility for theft, loss, or damage to personal belongings left on-site, including in lockers.

Clients are encouraged to obtain personal insurance coverage for bodily injury or property damage.

8. Access and Conduct Policy

Access is limited to clients with an active reservation and up to a maximum of three (3) guests.

Loud, aggressive, disrespectful, or dangerous behavior toward other users, staff, or facilities is strictly prohibited.

Le Birdie reserves the right to expel, without notice or refund, any person violating these rules.

9. Reservation and Cancellation Policy

All reservations must be made through Le Birdie’s official online reservation system.

Cancellations or modifications must be made at least 6 hours in advance to be eligible for a refund.

After this deadline, no refund requests will be accepted, but credits may be issued at Le Birdie’s sole discretion.

No refunds will be issued for no-shows.

10. Food and Beverage Policy

Clients may bring their own food and non-alcoholic beverages, provided they maintain cleanliness in the facility.

Waste must be disposed of in the appropriate bins.

Le Birdie reserves the right to charge cleaning fees in cases of non-compliance.

11. Privacy and Video Surveillance

For the safety of clients and staff, surveillance cameras are installed in common areas.

Recordings may be used for security purposes, internal management, or as evidence in case of disputes.

By accessing our facilities, users consent to being filmed as part of these security measures.

12. Force Majeure

Le Birdie shall not be held liable for any service interruption, loss of access, or temporary closure caused by events beyond its control, including but not limited to: natural disaster, power outage, fire, pandemic, government action, strike, or any other unforeseeable event.

13. Modification of Terms

Le Birdie reserves the right to modify these General Conditions at any time.
Updates will be posted on the official website or displayed in the facilities.
Continued use of our services after publication constitutes acceptance of the updated terms.

14. Governing Law

These conditions are governed by the laws of the Province of Québec.
Any dispute shall be submitted to the exclusive jurisdiction of the courts of Montréal (Québec).
